Settlors, trustees and beneficiaries may no longer have to live with irrevocable trusts established years ago under circumstances that have unexpectedly evolved. Particularly as a result of the enactment of the Uniform Trust Code and decanting statutes in many states, changing or terminating trusts is becoming almost commonplace. During this teleconference, we will discuss the following issues:
- Does the term "irrevocable trust" still mean anything?
- Changing a trust's situs and governing law
- Under what circumstances a trustee may have a duty to modify or decant
- Can a trust settlor foreclose future modification or decanting of a trust?
